Agreement to Terms
By accessing our website or using our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.
Our Services
Todd's Nursery & Landscaping provides:
- Residential landscape design and installation services
- Retail nursery sales (plants, trees, shrubs, garden supplies)
- Pond and fountain supplies
- Delivery services for nursery purchases
Landscaping Services
Estimates & Proposals
All landscaping estimates are provided after an on-site consultation and are valid for 30 days unless otherwise noted. Estimates are based on conditions observed at the time of the consultation. Unforeseen conditions discovered during installation may affect the final cost.
Change Orders
If changes to the project scope are requested or required, we will provide a written change order detailing the additional work and cost. We will always get your approval before proceeding with any changes that affect cost or timeline.
Payment Terms
Payment terms are outlined in individual project contracts. Typically, a deposit is required to secure your spot in our project queue, with the balance due upon completion.
Project Timeline
We will provide an estimated timeline for your project. While we strive to meet all deadlines, factors such as weather, material availability, or unforeseen site conditions may affect completion dates. We will communicate proactively about any delays.
Nursery Sales & Policies
Plant Warranty
Hardy nursery stock is guaranteed for 6 months when planted properly and maintained with adequate water. To make a warranty claim:
- Original receipt is required
- The deceased plant (or clear photo) must be provided
- Refunds are issued as store credit only
Exceptions (not guaranteed): Tropical plants, Emerald Green Arborvitae, Sub Alpine Trees, and sale/clearance items.
Returns & Refunds
- Refunds are in the form of store credit only — no cash refunds
- Plants cannot be returned once they leave the nursery
- Hard goods may be returned undamaged with receipt
- Custom hard goods and fountain rocks incur a 40% restocking fee
Delivery
Delivery is available to local areas within our service region:
- 1-person delivery: $100
- 2-person delivery: $200
- 3-person delivery: $300
Rates for deliveries requiring additional personnel or equipment are determined by our staff.
Website Use
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the website
- Copy or reproduce our content without permission
Intellectual Property
All content on this website, including text, images, logos, and design, is the property of Todd's Nursery & Landscaping and is protected by copyright laws. You may not use our content without written permission.
Limitation of Liability
Todd's Nursery & Landscaping shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our liability is limited to the amount paid for the specific service in question.
Indemnification
You agree to indemnify and hold harmless Todd's Nursery & Landscaping from any claims, damages, or expenses arising from your use of our services or violation of these terms.
Governing Law
These Terms of Service are governed by the laws of the State of Washington. Any disputes shall be resolved in the courts of Pierce County, Washington.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of modified terms.
